- House Floor Consideration of Fiscal Year 2021 Budget Resolution: The full House of Representatives this week is expected to take H. Con. Res. 11, the Fiscal Year 2021 budget resolution.
Parliamentary Situation. At the time of this writing, the parliamentary situation that will govern House floor consideration of the budget resolution had not yet been publicly revealed.
Background. The measure is a "skinny budget resolution" designed to provide a vehicle for facilitating a reconciliation bill that would be comprised of President Biden's COVID-19 relief proposals.
As introduced, the measure includes reconciliation instructions to 12 House committees: the House Committees on Agriculture; Education and Labor; Energy and Commerce; Financial Services; Foreign Affairs; Natural Resources; Oversight and Reform; Science, Space, and Technology; Small Business; Transportation and Infrastructure; Veterans’ Affairs; Ways and Means. Together, the instructions require the committees to report legislation that would increase the deficit by $1.9 BILLION in fiscal year 2021.
The measure does not include reconciliation instructions to the House Committee on Appropriations. However, it is believed that the Appropriations Committee will work with the authorizing committees on large portions of the ensuing reconciliation bill and that, as a result, the reconciliation bill that is assembled pursuant to the resolution will include increases in discretionary spending..
It would be highly unusual for authorizing committees to include discretionary spending in reconciliation legislation. But it has been done in the past.
Summary of Immigration Provisions. The measure does not contain any immigration-related provisions. However, the assumptions underlying the reconciliation instructions presume some changes with respect to immigrants.
Outlook. Uncertain.

- Senate Floor Consideration of the Nomination of Alejandro Mayorkas to be Secretary of Homeland Security: The full Senate this week will continue its consideration of PN78-13, the nomination of Alejandro Mayorkas, of the District of Columbia, to be Secretary of Homeland Security.
Parliamentary Situation. The Senate expects to vote on the nomination at 5:30 pm EST on Monday, February 1, 2021.
Department of Homeland Security Jurisdiction Over Migration Matters. The Department of Homeland Security houses as number of agencies and bureaus, including several with jurisdiction over immigration enforcement and immigration benefit adjudication, including the Immigration and Customs Enforcement (ICE); Customs and Border Protection (CBP); and Citizenship and Immigration Services (USCIS) components.
Outlook. The Senate is almost certain to confirm the nomination.
Tuesday, February 2, 2021, and the Balance of the Week
- Senate Floor Consideration of Fiscal Year 2021 Budget Resolution: The full Senate could as soon as this week take up S. Con. Res. ___, a yet-to-be-introduced Fiscal Year 2021 budget resolution.
Parliamentary Situation. At the time of this writing, no unanimous consent agreement providing for the consideration of the budget resolution had been reached.
Background. At the time of this writing, the text of the measure had not yet been publicly revealed. It is widely believed that its text will be almost identical to the text of H. Con. Res. 11, the Fiscal Year 2021 budget resolution introduced in the House on Monday, February 1, 2021. That measure is a "skinny budget resolution" designed to provide a vehicle for facilitating a reconciliation bill that would be comprised of President Biden's COVID-19 relief proposals.
